California SB-98 Immigration Resources

California law聽 on immigration enforcement requires Scripps College to:
  • Implement and publicize rules about access to personal information and the campus
  • Provide access to certain resources
  • Take certain actions if immigration enforcement is anticipated
  • Notify the campus community of confirmed immigration enforcement on campus
  • Designate a school official responsible for implementing the steps above

STEPS TO TAKE

If Enforcement Action is Expected

Notify Campus Safety immediately at (909) 607-2000 or [email protected] if:

  • 聽An immigration officer is expected to enter, will enter, or has entered campus to execute a federal immigration order.
  • Please do not attempt to verify the legality of any warrant, court order, or subpoena yourself.

Campus Safety acts as Scripps College’s first-response authority.

Emergency Contact Information

If there is reason to suspect that a student or employee has been taken into custody because of an immigration enforcement action, Scripps College must notify the person鈥檚 emergency contact if the individual has directed the College to do so.

To ensure the College has accurate emergency information:

ACCESS

Personal Information

Under state law, unless a disclosure is permitted by state and federal education privacy laws such as FERPA, employees are prohibited from discussing the personal information, including immigration status information, of any student or employee with anyone, or revealing that personal information to anyone.

As a reminder, under those privacy laws,聽internal聽disclosures聽are allowed for聽those with a聽legitimate need to know.

Campus Access & Warrants

Scripps College requires a judicial warrant to give access to areas of campus not open to the public for immigration enforcement.

Warrants:

  • Many of the questions below refer to 鈥渨arrants鈥� presented by immigration enforcement officers. Immigration enforcement officers use two kinds of warrants: administrative warrants and judicial warrants.
  • Administrative warrants do not empower immigration enforcement officers to enter non-public areas.
  • All references in the below FAQs to 鈥渨arrants鈥� refer to judicial warrants, unless specified otherwise.
  • General questions about the difference between administrative and judicial warrants should be directed to Campus Safety, 909-607-2000.
  • If you are presented with a warrant by an immigration enforcement officer, contact Campus Safety immediately at (909) 607-2000 or [email protected].

RESOURCES

Legal Services

As required by law, Scripps College maintains a non-exhaustive who provide legal immigration representation and other resources. It is available free of charge to all who request it and is provided via email each semester to all students and employees, along with guidance about their rights under state and federal immigration laws and how to respond to a federal immigration action or order.

According to California state law:

  • If聽an undocumented student is detained, deported, or is unable to attend to their academic requirements due to a federal immigration order, the College聽shall assist the student in retaining any聽eligibility for financial aid,聽fellowship stipends, funding for research or other educational projects,聽housing stipends or services, and permit the student to re-enroll if and when聽the student is able to聽return to the College.
  • The College shall ensure that staff are available to assist undocumented students, and other students and employees, who may be subject to a federal immigration order or inquiry, or who may face similar issues, and whose education or employment is at risk.

What if the authorities have a warrant or a subpoena?

  • If the officer presents a warrant, court order, or subpoena, contact Campus Safety immediately at 909-607-2000 or [email protected].
  • Do not attempt to verify the legality of any warrant, court order, or subpoena yourself.

Could I get in trouble for asking to see a warrant or subpoena?

  • California鈥檚 law prohibits Scripps College from consenting to warrantless entry by immigration officers to non-public areas. As such, Scripps College, through its employees, is obligated to require immigration officers to present a warrant, court order, or subpoena prior to allowing them entry to non-public areas.

Will Scripps College provide my personal information to immigration enforcement officers?

  • Not unless ordered to in a warrant, court order, or subpoena. The law prevents Scripps College employees from disclosing the personal information of its students or employees to immigration enforcement officers except in response to a judicial warrant, court order, or subpoena.

What is Campus Safety’s role?

  • Campus Safety鈥檚 role is to maintain a safe and secure environment at Scripps College. It is not the role nor responsibility of Campus Safety to carry out other law enforcement or security operations, including the enforcement of federal immigration law.

What information constitutes personal information?

  • The California law does not explicitly define personal information. In general, it would include any information protected by FERPA, including one鈥檚 immigration status. Scripps College also considers the immigration status of one鈥檚 family members to be personal information. At a minimum, 鈥減ersonal information鈥� also includes, but is not limited to, a person鈥檚 address, phone number, email address, course schedule, known associates, and student or personnel record.

Can I share the personal information of other faculty or staff?

  • The law prohibits disclosure of personal information except as required by a warrant, court order, or subpoena.

What if a student discloses personal information to me?

  • Keep this information to yourself and do not track it.
